Hypothetical Question

Hi all, hypothetical question suppose you are driving down a slow gradient full of leaves to a stop sign and come to a halt when a vehicle hits you on the corner on the nearside you hear the bang and get out to see a car one quarter past you with damage on the wheel arch on the offending vehicle and little more than a scratch or two on your own vehicle, who would you say was to blame if the offending driver refuses to own up to the damage and begins to give excuses.

I am asking this for a friend and I am not fully aware of the real story as I was not in the car or at the scene of the offence, I personally feel that the car at the rear would be to blame in this instance.

What do you guys think ?

On the information you have given, as your friend was stationary and hit from behind by another driver, it’s a no brainer really.

Excuses or no excuses the other driver was going too fast and too close and not driving appropriately for the road conditions.

The insurance company and a solicitor will deal with it for your friend
