T-sport Written Off

My son recently ( 6 weeks ago ) bought a nice T-sport & spent £300 making it look even more of a good looking car.

He phoned me today at 2pm to sat it had been written off. Three Tw*ts in a knackered Fiesta running from Police Smashed into front right side of car & have written it off. All 3 of them were only 15/16. Driver was apparently caught but other 2 :censor: ran off.

It gets worse. The car is only covered 3rd party, however, we have 3 witnesses & at the time Police were following the stolen car but did not see the accident. Not sure now if he will get any compensation/Insurance payout.

He is totally gutted as he loved it! He has fortunatley pickd up a PX Starlet at his dealership to get him by for now.

Just have to wait now to see if we can sue the driver & claim cost of vehicle, medical expenses & all other costs incurred.

was your son injured?

even the slightest little thing, just make a big a deal as possbile about it, and claim all that you can for it.

claim all sorts

emotional distress, now afraid of driving, affecting job, loss of earnings

Centimental value of car, very attached to vehicle, emontional distress again.

broke a nail, causing pain when using finger.

no one can disprove pyscological issues so you never really lose (if its beliviable of course)

Terrible news but at least he has walked away. The Yaris is a tough car.

The chances are the driver of the other car will be un-insured. Compensation/Insurance payout will require a solicitor and a claim made through the Motor Insurance Bureau.

As your son was only Third Party I’m not sure if he would have the use of the legal department from his insurance company (I know you get this with fully comp).

He could also claim from the cars owner (if they are insured) even though it was stolen.

Either way it’s a bit of a mess and will take time to sort out. A good solicitor is the next step.

You are correct in the fact that I need to arrange a solicitor PDQ. Still waiting for Police to contact us regarding the little :censor: who they caught, probably told him to go home & "don't do it again"! Also waiting to hear if stolen vehicle was insured.

I have my claim form ready form MIB just in case..........

Looking at the state of the car, it is a minor miracle that he walked away without any major injury. It has all hit him today though & keeps going on about his beloved Yaris T-Sport.

I'll let you know how it all goes. :thumbsup:

Oh no, that sounds like an awful thing to happen :(

Good luck with the MIB claim - I worked in Motor Insurance claims for 4 years until May so if you need any advice I'll do my best to help :)

Don't the insurance companies have a scheme to cover you in a situation like this?

They're forever telling us that high premiums are caused by uninsured drivers - so surely they're putting aside a little bit of everyone's premium for this kind of eventuality?

Same scenario with my T Sport back in December, all I can say is insurance companies are the biggest t**ts in situations like this. I hope your son was ok, and that the other guys get whats coming to them.

UPDATE

Firstly, my son appears to be OK with no apparent injury........

The little F :censor: er who was caught was 16, had no licence or insurance & was in possession of cannabis. The car cannot be traced to any owner by Police or Insurance. Insurance company have appointed a dedicated advisor & appears to be as pro-active as we are ( Bonus ). We'll see how long it lasts.

Have claimed against Motorist Insurance Bureau as advised by insurance company. Fingers crossed.

Had to pay £240 today to recovery firm to cover cost of removing from scene & 4 days storage. What a rip off!! Have now moved it to a non-charging premises.

Will take some photo's over next couple of days & post them.

If it's written off, I will list parts available for auction.

UPDATE

I would be tempted to take out a private civil case against the driver (or his parents/guardians). He has to be held accountable for his actions. Why should the innocent party always carry the can?

These scum teenage chavs get away with too much. Its time the decent honest hard working people of this country stand up and say “Enough is Enough”

Have already discussed this with police & they have encoured us to do it. However, they have also informed us that regardless of what is awarded, they will declare they cannot pay it.

MIB apparently will sue the driver to claim back whatever they pay us, but cannot do this until he is 18. Looks like the b :censor: rd is untouchable.

Anyway, will see what happens with MIB but have been informed by them that it will take 5-6 months to sort out.

Will keep you all up-to-date with the Yaris & parts available ( if it's declared a write-off).

Update!!

MIB have assessed car today & declared it a total write off. Just need to wait for written confirmation.

Alloy wheels are already taken as is stereo unit.

Front end is totalled & there is minor damage to N/S body & door. Both air bags & Drivers seat belt have deployed

Post amended: You should be a paying member to sell on the TOC forums

Will post some images of car over the weekend.

I can see why he walked away from it unharmed, the passenger cell is untouched, the car has done its job and your son is unharmed, still a shame to see a Yaris like that though.

its not always easy to see the full damage from pics but that looks repairable. yes the air bags will either need replacing or removing but actual damage looks minor

The MIB have officially written off the car & classed it as unrepairable.

The main longitundinal structure is twisted on RHS which will require some major repair work & geometry resetting.

Total repair cost will be IRO £5000.
