I Think I'm Being Fobbed Off (Advice Would Be Helpful)

Morning all,

I've just had a massive row with a company auto-bulbs-online. I bought 2 pairs of indicator bulbs from them at £13 a pair. This was last Friday, hadn't heard from them so called today. Apparently I ordered from the .co.uk website, the .com website shows the bulbs at £24.99 a pair!!! something to do with them being discontinued.

They have said I can have the bulbs for £16.49 a pair as a good will gesture for them selling me bulbs at old price, but I think I am entitled to them at £13, as that was the advertised price when bought, and I have the worldpay receipt to prove it. The money already came out on monday.

I'm not that hot on my consumer law, so any advice would be helpful.

You need to have a read of the terms and conditions of the company you purchased from and then have a look at the following laws and regulations:

The Distance Selling Regulations 2000, Electronic Commerce Regulations 2002, The Trade Descriptions Act, and the Sale of Goods Act 1979.

The section on "Prior Information" seems to be most relevant to your situation as it relates to the price of the goods and how long that price is valid for.

Or just Google "distance selling law uk"

You could also have a chat with your local Citizens Advice Bureau and see what they say.

Thanks for your help.

Turns out they were in breach of contract, but as long as they offer a full refund without penalty, they do not have to sell at the reduced previously advertised price!!

But apparently the guy at consumer direct has to pass it on to trading standards, as the ad on the website is potentially criminal as it's false advertising..... My advie is just to ignore the company!!

You dont have to give a reason to return anything under DSR law within 7 days, just send them back and get a refund. A price shown on a website should not be misleading, but mistakes occur. If they were on sale for £13 and you agreed to buy them at £13 and they agreed to sell them at £13 then a contract has been formed, if you paid £13 and they contacted you to say there was an error and they could not do them for that price then no contract is formed and you dont get your bulbs. They cant have it both ways, send you bulbs and then charge you a higher price
