Advice On A Car I Have Just Sold

To fund the recent purchase of my tourer I sold my wifes fiat and my own MG ZR.

The MG was sold yesterday. It was a good clean little car with an extensive main dealer service history and was maintained regardless of cost. It had no known problems and had never given me any trouble in the year and a half that i had owned it.

This evening i had a call from the guy who bought it saying that he was having trouble with it, something about the engine dying and having no power etc. He hasnt asked for anything and was just calling for advice in case I knew what may be wrong but I am now concerned that this may be the start of something like asking for money back or help towards any repairs.

I am sorry for the bloke but the way I see it is that I sold him a perfectly good car in good faith and I cannot be held responsible for what has happened to it in the 100 miles he has covered since taking it away. At the end of the day its now his car.

Any advice?

My advice would be he bought as seen and if he done a 100 miles in it, i would say its his driving not the vehicle, up to him to get it sorted now, he might be trying to pull a fast one its all down to him now not you.

did you write a sold as seen reciept for him and 1 for you that he signed

Wrote him a reciept but did not keep a copy for myself.

From what I understand from my research on the net there is very little that he can do about it unless he can prove i knowingly sold it with faults which as far as i am aware it did not have.

The law is Caveat Emptor,(beware the buyer). There is no legal comeback on you unless it could be proved that you deliberately mislead the purchasor.

For private sales...

The general rule is ‘let the buyer beware’ when you buy from a private individual. It is up to you to find out whether the car is of satisfactory quality, to make your own checks on what you are told and to take responsibility for your choice, as the seller is not liable for the satisfactory quality of the vehicle.

As long as the car was as described and could pass an MOT then you are not really liable for much else.

The car was probably better than I described and I had an MOT done last week which it went through with no problems.

I myself bought a Kawasaki GPZ500 motorcycle a couple of years back for a bargain price. When I got it home there were a few things that were wrong with it which ended up costing me £700 to get fixed. I just had to accept it and get on with it. I didnt even think of calling the seller back.

If he calls again I think I will be polite but brutally honest, its his responsibility now and it appears he has broken it.
