Help Engine Trouble.....:(

Hi... I am new to this sight and found out about it through a friend.

My wife has a RAV 4 VX 2002 model. 5 months after the warrenty ended the engine gave out on the motorway in very dangerous circumstances. I have not had any help from toyota that has been at all constructive. The car has been maintained correctly throughout the time we have owned it (From New). I am now expected to pay around £6000.00 to pay for a new engine !!! The car is only 3 years and 5 months old. This should not be happening.

Can anyboby help me and advise me what my options are.

Thank you in advance

Hi,

If the car has a complete Toyota service history with servicing on time, does not have inter-galatical miles and was correct on all fluid levels at the time of the failure, then I would ask Toyota's technical engineers to come and assess the engine failure through your dealership.

You may have to be a bit pushy, but remain polite, with your local dealer as he can support you in any claim against Toyota. Remember though that you do not let your dealer have the final decision. I know claims have been settled outside of warranty, trust me.

Not sure how the sale of goods act applies to cars, but i do know for a fact that a product has to be "fit for the purpose" for a period of 6 years from manufacture. If this applies to cars too, and as you have a full Toyota service history you should be able to make a warranty claim, as you would expect an engine to last a LOT longer than 3½ years!!

Maybe worth speaking to your local Trading Standards office and/or a solicitor who specialises in consumer goods etc.

Hope you win.

Phil.

I have a 3 year old diesel rav 4, 50,000 miles. the clutch wears out once a year! this is it's 3rd clutch. Toyota & dealer replaced the first one under waranty saying that the flywheel had failed, but claimed the second failure at 27,000 more miles was "fair wear & tear". Odd that since I've been driving for 20 years and never had a clutch failure before and never go off road. This generation of rav4s have apparently a record of major transmission failures. It is however easy to give an impression of reliability by denying that there is any cover under waranty. I have the parts (flywheel & clutch removed at the last failure). How do I find a contact at toyota to send them on to and how do i challenge the £1300 bill that I have payed to the frachcise. Note that the franchise dealer will claim that they do not represent toyota but that you don't get to deal directly with customer service.

Hope you win.

Phil.
